Terms of Service

Welcome to LeadsGen. These Terms of Service (“Terms”) govern your access to and use of the LeadsGen platform, website, and services (collectively, the “Service”). By creating an account or using the Service you agree to be bound by these Terms.

1. Accounts

1.1 Eligibility

You must be at least 18 years old to use the Service. By registering, you represent that the information you provide is accurate and current.

1.2 Account security

You are responsible for maintaining the confidentiality of your login credentials and API keys, and for all activity under your account. Notify us immediately at security@leadsgen.app if you suspect unauthorized access.

1.3 Workspaces & members

Workspace owners may invite members and grant roles (Owner, Admin, Member, Viewer). Owners are liable for all activity performed by members within their workspace.

2. Subscriptions & Billing

2.1 Plans and credits

Subscription plans grant a monthly allocation of credits. A lead is charged one credit only when a valid email address is returned. Unused credits do not roll over unless explicitly stated. Plans and prices are listed at /pricing and may change with 30 days' notice.

2.2 Payment

Payments are processed by Stripe. By providing payment information you authorize LeadsGen to charge your selected payment method on each billing cycle. Failed payments may result in suspension until resolved.

2.3 Refunds

New customers may request a full refund within 7 days of first subscription purchase. See our Refund Policy for details.

2.4 Taxes

You are responsible for all applicable taxes. Stripe collects and remits taxes where legally required.

3. Acceptable Use

You agree NOT to use the Service to:

  • Send unsolicited bulk email (spam) or violate CAN-SPAM, GDPR, CASL, or local anti-spam laws
  • Harvest or scrape personal data unrelated to legitimate business purposes
  • Attempt to reverse-engineer, bypass rate limits, or overload the Service
  • Resell or white-label the Service without an Agency plan
  • Upload malware, phishing content, or illegal material
  • Scrape data from websites in violation of their robots.txt or terms of use

Violations may result in immediate account suspension without refund. See our Acceptable Use Policy.

4. Data Ownership & Privacy

4.1 Your data

You retain ownership of all data you upload to or generate within the Service (“Customer Data”). You grant LeadsGen a limited license to process Customer Data solely to provide the Service.

4.2 Scraped data

Lead data scraped via the Service is provided “as-is” from third-party sources. You are responsible for complying with applicable data protection laws when using this data for outreach.

4.3 Privacy Policy

Our Privacy Policy explains what data we collect and how we use it. For GDPR-regulated customers, our Data Processing Agreement applies.

5. Intellectual Property

The Service is owned by LeadsGen and protected by copyright, trademark, and other laws. These Terms do not grant you any right to use our trademarks without prior written consent.

6. Third-Party Services

The Service integrates with third parties (Stripe, Apify, OpenAI, Perplexity, AnyMailFinder, Resend, n8n, DataForSEO). Your use of those services is governed by their respective terms.

7. Service Availability

We aim for 99.5% uptime but do not guarantee it. We may update, modify, or discontinue features at any time. Material changes will be announced at least 30 days in advance when feasible.

8. Termination

You may cancel your subscription at any time via /billing. Cancellation takes effect at the end of the current billing period. We may suspend or terminate your account for breach of these Terms, non-payment, or suspected fraud.

9. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED “AS-IS” WITHOUT WARRANTY OF ANY KIND. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PRIOR 12 MONTHS.

10. Indemnification

You agree to indemnify and hold LeadsGen harmless from any claims arising out of your use of the Service.

11. Governing Law

These Terms are governed by the laws of the jurisdiction where LeadsGen is incorporated. Disputes shall be resolved through binding arbitration.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or in-app banner at least 14 days before taking effect.
